Futbolium is a football management game. The first season of every career is free. The full game is a single purchase that unlocks every season after the first and all three save slots. Futbolium Club is a subscription that lets you start online leagues. Joining a league is always free. Both are sold by the App Store or Google Play, and their rules on payment, cancellation and refunds apply.
Online leagues are optional. If you play online, be decent to the other managers: choose a manager name that would not offend anyone, and do not try to cheat or to break the server.
These terms are an agreement between you and the developer named under "Contact". By installing or using the game, you accept them. If you do not accept them, do not use the game.
You may use the game for your own personal, non-commercial entertainment on any device you own or control, within the rules of the store you got it from. You may not copy, sell, rent or redistribute the game, take it apart to get at its source code beyond what the law allows you to do anyway, or use it to build a competing product.
Every club, player, competition, stadium and crest in the game is invented. There is no real-world football data and no licensed content, and any resemblance to a real club, competition or person is unintended.
Names you import. The game lets you load a file of your own club and player names into a career on your device. What you import is yours and stays on your device. You are responsible for having the right to use it. Imported names are not shared with other managers.
Nothing you can buy makes your club stronger or wins a match. There is no in-game currency, and there are no adverts.
Online play is optional and only open to people aged 14 or over.
Your online account is made when you first go online and has no password. You can add an email address so that you can get the account back on a new phone. Keep access to that email address to yourself: whoever can read the code sent to it can use your account.
Your manager name is seen by the other managers in your leagues. It must not be offensive, hateful, sexual, impersonate someone else, or contain personal information such as a phone number. Names that break this rule may be changed or removed.
Fair play. Do not:
If you break these rules, your online account can be suspended or deleted, and your club in a league can be handed to a computer manager. This does not affect your offline careers or anything you bought; a Club subscription you no longer need can be cancelled in your store account.
The online service runs on a server operated by the developer. It is offered as it is: matchdays are played on a timer and may occasionally run late, and leagues, features or rules may change as the game develops. If online leagues are ever closed down for good, at least 30 days' notice will be given in the app. Any Club subscription will stop renewing before they close.
Deleting your account. You can delete your online account at any time from Club → Online leagues. What is erased and what stays in your leagues' history is explained in the privacy policy.
How the game handles personal data is set out in the privacy policy, at https://www.playfutbolium.com/privacy-policy.html. It is part of these terms.
The game is provided as it is and as it is available. Reasonable care goes into it, but it cannot be promised to be free of errors or always available, and a save or an online league may be lost through a fault. Keep a backup of careers that matter to you, from the Saves screen.
Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, for fraud, or for intent or gross negligence. Within that limit, the developer is not liable for indirect or consequential loss, and in any case not for more than you paid for the game in the twelve months before the claim.
Your rights as a consumer under the law of the country where you live are not affected by anything in these terms.
If you got the game from the App Store, Apple's Licensed Application End User License Agreement also applies, at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where it and these terms differ, these terms apply, unless Apple's agreement says otherwise. Apple is not responsible for the game or its support, and is not a party to these terms, but Apple and its subsidiaries may enforce them as third-party beneficiaries.
If you got it from Google Play, Google Play's Terms of Service also apply to how you got it and paid for it.
If these terms change, the date at the top changes with them, and the new version is published at the same address. A significant change for online players or subscribers will also be announced in the app before it takes effect. If you keep playing after a change takes effect, you accept it. If you do not accept it, you can stop using the game, delete your online account, and cancel any subscription in your store account.
These terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in its courts. Before going to court, please write to the address below: most problems can be solved by email.
The game is made by an individual developer, Daniel Martínez. For any question about these terms, write to [email protected].
